Payment Agreement

This agreement is made by texttomp3 user (hereinafter referred to as "the user") on the use of the automatic renewal Commission deduction service provided by texttomp3 (hereinafter referred to as "the service"). This agreement describes the rights and obligations between texttomp3 and the user regarding the use of the service and related aspects. "User" and "you" refer to the individuals who enjoy texttomp3 to provide this service. This Agreement constitutes a prerequisite for the user to use the service provided by texttomp3. Unless the user accepts the terms of this agreement, the user has no right to use the service. The user's choice to use the service will be deemed to agree to be bound by the terms of this agreement.

1、 Confirmation and acceptance of continuous monthly service terms

All network service ownership and related intellectual property rights involved in the continuous monthly service shall be owned by texttomp3 according to law and protected by the laws of the people's Republic of China and international conventions. The scope of validity of the terms under this service agreement covers all network services of texttomp3. When users complete the registration process and start to use the automatic renewal service provided by texttomp3, they shall be bound by the terms of this service agreement.

When the user uses the automatic renewal service, the user's use behavior will be deemed as his consent and acceptance of the relevant terms of the service and various announcements issued by texttomp3 in the service.

2、 Description of Automatic Renewal Service

2.1 the service is based on the user's demand for automatic renewal. On the premise that the user has opened the service, the service is launched to avoid the loss caused by the user's failure to renew in time due to negligence or other reasons. After the user opens the service, he / she agrees that texttomp3 can issue a deduction instruction to the user account according to the deduction rules of the payment channel when the user's validity period is about to expire, and agrees that the account can deduct the next charging cycle from the account without verifying the member's account password, payment code, SMS verification code and other information according to the deduction instruction issued by texttomp3. Once the deduction is successful, texttomp3 will open the member service in the next billing cycle for the member, and will record the deduction in the member consumption record on the day of the deduction, and extend the member service period accordingly. The premise of the service implementation is that the user has bound his texttomp3 user account with the above account, and can successfully deduct money from the above account. Billing cycle: such as monthly, consecutive monthly, and consecutive year, etc. (the details are subject to texttomp3), members can choose by themselves.

2.2 automatic renewal refers to the deduction method that texttomp3 collects the user's next billing cycle fee through the above account based on the premise of 2.1. The user shall ensure that texttomp3 can be deducted from the above account successfully. If the renewal fails due to the insufficient balance of the account and other reasons of the user, the user shall bear the responsibility.

2.3 all intellectual property rights involved in or possibly derived from the automatic renewal service shall be legally owned by texttomp3, and users shall not automatically obtain any or all of their rights due to the use of the automatic renewal service.

2.4 texttomp3 constantly improves the service quality and modifies the service terms according to the development of Internet and changes of relevant laws and regulations of the people's Republic of China. Texttomp3 shall have the right to update the service agreement at any time without notice, and shall not be liable for any compensation due to the recovery of the said use.

2.5 texttomp3 recommends users to pay attention to the terms of this service agreement on a regular basis. When users think that the adjustment of any or all terms of this service agreement is unacceptable, please terminate the relevant services provided by texttomp3 in a timely manner.

3、 Term and termination of Automatic Renewal Service Agreement

3.1 this Agreement shall come into force after the user chooses to accept and use the service. Unless otherwise specified by texttomp3, the automatic renewal service obtained by users is long-term effective. The service is terminated until the user terminates the service.

3.2 the user has the right to choose to terminate the service at any time. The cancellation method: you can cancel the automatic renewal service at any time for any reason. After the termination of the service, texttomp3 will stop providing the relevant content of the service to the user.

3.3 the instruction that the user has entrusted texttomp3 to automatically renew the fee deduction before the service is terminated is still valid. Texttomp3 will not refund the deducted fee based on the instruction, and the user shall bear the relevant fee and responsibility.

4、 Rights and obligations of both parties of Automatic Renewal Service

4.1 texttomp3 needs to provide the user with a query method about the specific situation of automatic renewal charge (the user can query the relevant order and consumption record in "my VIP member"), but it is not responsible for printing the relevant invoice and forwarding it to the user.

4.2 for the next billing period deducted by texttomp3, the payment shall be recorded in the user payment record, and the corresponding service validity period shall be extended at the same time.

4.3 in case of any problem in the fee deduction process, texttomp3 shall closely cooperate with the user to find out the cause and each party shall bear the loss caused by its own fault; if the loss is caused by the unequal fault of both parties, both parties shall bear the corresponding degree of responsibility according to the fault degree; if both parties are jointly responsible, both parties shall share the responsibility equally.
4.4 texttomp3 can change or modify the relevant service content, rules and terms of this agreement according to its own business development or technical upgrading. Texttomp3 shall publicize the modified contents on the relevant pages of texttomp3 before making the above changes or modifications, but shall not be obliged to give individual notice to the user. If the user disagrees with the modification of this agreement, he can cancel the obtained service and stop using it; if the user continues to use the service, it is deemed that the user has accepted all the modifications of this agreement.

4.5 the service shall be cancelled at the user's option. If the user does not cancel the service, it shall be deemed that the user agrees that texttomp3 will continue to charge and deduct according to certain rules (long-term and unlimited by times). Once the deduction is completed, texttomp3 will open the next billing cycle service for users.

4.6 if texttomp3 service price is adjusted during automatic renewal, the current effective price shall prevail.

4.7 texttomp3 does not charge any fees for opening the service, but texttomp3 has the right to decide whether to charge for the service itself or adjust the automatic renewal cycle and fees according to the future business needs or market changes and other relevant reasons, and publicize them to users on the relevant pages.

4.8 for the selected payment channel, users are obliged to pay attention to and ensure that there is sufficient balance under the account of the payment method to meet the application of automatic renewal service. If the automatic renewal service cannot be completed due to the above reasons (including but not limited to insufficient balance), texttomp3 has the right to suspend the related services accessed by users through the automatic renewal service without further notice.

5. Refund

Texttomp3 specially reminds users: when users open and use the automatic renewal service, they entrust texttomp3 to deduct the payment in the default payment channel of users. Texttomp3 will be deemed as the user has chosen to subscribe to the relevant payment services of texttomp3. Texttomp3 will not refund the user's fees in any way.

6、 Guarantee of legality

The user acknowledges and warrants that it will not use the automatic renewal service to directly or indirectly engage in the following acts in violation of national laws and regulations and social public order and good customs:

Violating the basic principles established by the constitution, endangering national security, disclosing state secrets, subverting state power and undermining national unity;

Those who damage the honor and interests of the state; those who incite national hatred, national discrimination and national unity; those who undermine the religious policies of the state and propagate heresy and feudal superstition; those who spread rumors, disturb social order and social stability; those who spread obscenity, pornography, gambling, violence, terror or abet crimes; those who insult or slander others and infringe upon their legitimate rights and interests; those who incite others Illegally assembling, associating, marching, demonstrating or gathering people to disturb social order; acting in the name of illegal non-governmental organizations; containing other contents prohibited by laws and administrative regulations.

Texttomp3 has the right to irregularly supervise the user's use of the automatic renewal service. Once it is found that the user is involved in the above-mentioned acts in violation of national laws and regulations and the moral reservation of social public order and good customs, texttomp3 has the right to recover the user's right to use the automatic renewal service without any compensation to the user. In addition, texttomp3 will report the user's behavior to the state authorities according to law and reserve the right to further investigate the user's behavior and cause texttomp3's loss.

7、 Commercial prohibition

The user acknowledges and agrees that the user shall not use the automatic renewal service in other fields other than texttomp3 service, nor directly or indirectly conduct any commercialization (including but not limited to: resale, trafficking, equivalent replacement, etc.) of the automatic renewal service without the formal written public permission of texttomp3. Once it is found that the user is involved in the above behaviors, texttomp3 has the right to recover the user's right to use the automatic renewal service without any compensation to the user, and reserves the right to further investigate the user's behaviors and cause texttomp3's loss.
